Although a significant number of civil litigation and family law court proceedings are commenced annually in the Province of Ontario, very few of those matters actually proceed to trial. In fact, speaking in rough terms, only 9% of Small Claims Court matters, 7% of family law proceedings, and 3.5% of civil cases in the Superior Court of Justice are actually decided at a trial. As a result, the skills required by litigation counsel often fall more within the realm of negotiation and resolution than within the world of trial advocacy. Unfortunately, that also means that there are limited opportunities for counsel to acquire real trial experience and, for that reason, if your matter is proceeding to trial then it is critical to work with a lawyer that has experience in actually preparing for and conducting trials.
